Information for Authorised Nominating Authorities

Applications for Registration

The Building and Construction Industry Payments Act 2004 establishes the provisions for the requirements and registration criteria for organisations interested in becoming registered as Authorised Nominating Authorities.

These provisions came into effect from 1 July 2004. It is from this date that the Adjudication Registry commenced accepting applications from interested organisations.

In order to apply, prospective Authorised Nominating Authorities must submit documentation in the approved application form and commit to a number of general conditions of registration.

Applications must be accompanied by the prescribed registration fee. The current registration fee is $1173.80.

Registration is for a term of three (3) years. Registration becomes effective on the day the Certificate of Registration is issued and ends three (3) years after that date, or on an earlier day stated in the Certificate.

Refer to the Building and Construction Industry Payments Regulation 2004, which prescribes application and renewal fees.


Applications for Renewal of Registration

Applications for renewal of registration must be made at least one (1) month before registration ends.  The Registry will issue a renewal application form ninety (90) days prior to the expiry of the registration.

Registrants must submit documentation in the approved application form and commit to certain conditions of registration.

Registration renewal applications must also be accompanied by the prescribed registration renewal fee. The current registration renewal fee is $1173.80


Compliance with Conditions of Registration

The Act makes provision for the suspension or cancellation of the registration of an Authorised Nominating Authority, if the Registrar believes there is grounds for doing so.

The grounds for suspension or cancellation are:

  1. the registrant is not, or is no longer, a suitable person to hold the registration;
  2. the registrant has contravened a condition of registration;
  3. the registration was issued because of a materially false or misleading representation declaration.
