IMPORTANT NOTICE REGARDING BCIPA PROCESS OVER CHRISTMAS PERIOD:

All days between Christmas (25th December) and up to and including 1 January are classed as "non business days" by BCIPA.

No one will be disadvantaged if they are serving a  payment claim or payment schedule or other notice during the Christmas "non business day" period.

For example:

Payment Claim served on 18/12/2009 (Friday)

Respondent has ten (10) business days to serve a payment schedule (response).

The day any notice is served is not counted as a business day when calculating timeframes in the BCIPA purposes

(19/20 DEC - weekend)
(21,22,23 &24 Dec are business days
25/26 Dec - Christmas
(27 - 31 DEC – non business days under the Act)
(1 JAN - New Years Day)

Therefore the first business day  is
21 December 2009


and the respondent has till


11th January 2010 to respond if the payment claim is served by fax or

12th January 2010 if the payment claim was posted

The same "down time" applies to all processes under the BCIPA regarding the service of documents, lodging of applications and responses and decisions.

 

Parties should also ensure they have considered any other public holiday, special holiday or bank holiday that may be relevant to the calculation of dates.

What are NON business days as defined by the Acts Interpretation Act 1954, section 36 and The Building and Construction Industry Payments Act 2004 :

A business day is NOT:

· Saturday or Sunday

OR                       

· A public holiday, special holiday or bank holiday in the place in which any relevant act is to be or may be done.

 In addition to the Acts Interpretation Act 1954 definition the BCIPA excludes the 27, 28, 29, 30 and 31 December.

Therefore in addition to the normal public holidays over the Christmas/New Year break the 27-31 December are excluded as business days.
